Terms of sale

These Terms of Sale apply to every order placed on marilynandco.com. By placing an order, you confirm that you have read and accepted them, together with our Shipping Policy, Refund Policy and Terms of Service.

2. Products

We sell women's tank tops and tops with a built-in bra, and related accessories. The main features of each product, its sizes and colors are shown on its product page. Photos are as accurate as possible, but slight differences in color or appearance may exist. Please check our size guide before ordering. Our products are everyday comfort garments and are not medical devices.

3. Orders

Your order is confirmed once payment has been accepted, and you'll receive a confirmation email summarizing it. We may refuse or cancel an order in case of suspected fraud, payment issue, obviously incorrect information, or stock unavailability; any amount charged will then be fully refunded.

4. Prices

Prices are shown in your local currency at checkout. All duties and import taxes are included: the total shown at checkout is the final price, with nothing extra to pay at delivery. Shipping is free with Standard Shipping; Priority Shipping is optional and its price is shown before you pay. The price charged is the one displayed when you place your order.

5. Payment

Payment is due when you place your order. Accepted payment methods are shown at checkout. Payments are processed securely by our payment providers; we never have access to your full card details.

6. Delivery

We currently deliver to the United States, Canada and Australia. Orders usually arrive within 4 to 14 business days after shipping (6 to 15 business days for remote areas). Delivery times are estimates. Full details, including tracking and our Shipping Protection included with Priority Shipping, are in our Shipping Policy.

7. 90-Day Perfect Fit Guarantee

If the size isn't right, tell us within 90 days of delivery and we'll send you a free replacement in the right size. You keep the original tank. Details are in our Refund Policy.

8. Returns and refunds

Unworn, unwashed items with their original tags can be returned within 30 days of delivery for a refund of the item price; return shipping is paid by the customer. Damaged, faulty or incorrect items are replaced or refunded free of charge. Orders can be canceled within 12 hours if they haven't shipped. All conditions are set out in our Refund Policy.

9. Product quality

If a product has a manufacturing defect or does not match its description, contact us within 90 days of delivery with your order number and a photo: we'll send a free replacement or a full refund for that item. This is in addition to any rights you have under the consumer protection laws of your country.

10. Liability

To the fullest extent permitted by law, our liability for any order is limited to the amount paid for that order, and we are not liable for indirect or consequential losses. Nothing in these Terms limits rights that cannot be excluded by law.

11. Customer service and disputes

For any question or complaint, email us at contact@marilynandco.com. We reply within 24 business hours, Monday to Friday, and do our best to find a solution quickly. Please contact us before opening a dispute with your bank or payment provider.

12. Governing law

These Terms of Sale are governed by French law, without depriving you of the protection of the mandatory consumer laws of the country where you live.
